1. Acceptance of Terms

By accessing or using Balinked (the "Site"), you agree to these Terms of Service ("Terms") and all applicable provisions of Indonesia's Electronic Information and Transactions Law (EIT Law). If you do not agree, do not use the Site.

2. User Content and Sole Liability

Content Responsibility. You alone are fully responsible for all information, data, text, graphics, and other content ("User Content") you submit, post, or make visible on the Site.

Legal Compliance. You warrant that your User Content complies with all applicable Indonesian laws, including criminal (e.g., defamation, hate speech) and intellectual-property laws under the EIT Law.

Safe-Harbor Procedures. Although Balinked operates takedown procedures for prohibited content, you acknowledge that Balinked's protection from liability depends on these procedures and that any failure or delay does not shift liability away from you.

3. Indemnification

You agree to indemnify, defend, and hold harmless Balinked, its owners, affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms;
• Your violation of any applicable law or the rights of a third party;
• Any User Content you submit.

4. Limitation of Liability

To the fullest extent permitted by law, Balinked shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, User Content, or any regulatory enforcement, even if advised of the possibility of such damages.

5. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising hereunder shall be submitted to the exclusive jurisdiction of the Indonesian courts.

6. Account Registration

To use certain features of our service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

7. Platform Availability

Balinked is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be available at all times or that it will be free from errors, viruses, or other harmful components.

We reserve the right to modify, suspend, or discontinue the platform or any part thereof at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the platform.

8. Compliance with Indonesian Law and Regulations

User Responsibility for Legal Compliance. You acknowledge and agree that you are solely responsible for ensuring compliance with all applicable Indonesian laws, regulations, and requirements when engaging in any professional activities, business relationships, or employment arrangements facilitated through the Platform.

Visa and Work Authorization. If you are a foreign national, you are solely responsible for obtaining and maintaining all necessary visas, work permits, stay permits (B211A, B213, Kitas, Kitap, etc.), and other legal authorizations required to work, conduct business, or provide services in Indonesia. Balinked does not provide immigration advice or assistance with visa applications.

Tax Obligations. You are responsible for understanding and complying with all Indonesian tax obligations, including but not limited to income tax, VAT, and any other applicable taxes related to your professional activities or business operations in Indonesia.

Business Registration and Licensing. If you operate a business in Indonesia, you are responsible for obtaining all necessary business licenses, permits, and registrations required under Indonesian law, including but not limited to NIB (Nomor Induk Berusaha), business entity registration, and any sector-specific licenses.

Employment Law Compliance. Any employment relationships or freelance arrangements must comply with Indonesian labor laws, including proper contracts, wage requirements, and worker protections. Users engaging local Indonesian professionals or being engaged by Indonesian businesses must ensure all arrangements comply with applicable employment regulations.

No Legal Advice. Balinked does not provide legal, immigration, tax, or business advice. We strongly recommend consulting with qualified Indonesian legal professionals, immigration consultants, or business advisors before engaging in any professional activities in Indonesia.

Indemnification for Non-Compliance. You agree to indemnify and hold harmless Balinked from any claims, penalties, fines, or legal consequences arising from your failure to comply with Indonesian laws and regulations.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.
